ACLU SUES U. S. GOVERNMENT FOR USING CRUEL AND UNUSUAL PUNISHMENT ON RECENTLY ARRESTED TERRORIST

The ACLU is suing the government for distributing a picture of Khalid Shaikh Mohammed, a suspected terroist and mastermind of many attacks on the U. S. and its properties, in his underwear

(pictured left). Recently nabbed by Pakistani police, Khalid Shaikh Mohammed was sleeping and in his underwear at the time police entered his house and arrested him. This unflattering picture was snapped at the time of his arrest. The ACLU is claiming that this picture is "debilitatingly embarrassing" to Khalid Shaikh Mohammed and demands that the picture be immediately be pulled from the airwaves and print. While descriptions from people at first sight of the photo vary among those surveyed, many of them view him as a vagrant, drunk, and most commomly, very hairy. Even Fox News commented on his picture, descibing him as having a "bad hair year." The ACLU says this is very different from the real Khalid Shaikh Mohammed, who is very powerful and successful in his line of work. While the lawsuit doesn't state specific damages, lawyers say they are very serious about pursuing this case.

The case stems from the widespread publishing and broadcasting of this photo worldwide. The ACLU claims that this publishing of the picture is distressing to Mohammed, even though no one inside the ACLU has ever spoke to Mohammed and some are even unsure he's seen it. Those involved in the case are positive that if he has seen it, they are sure it would be very distressing emotionally to Mohammed. They say this picture doesn't show the real Mohammed, and is damaging his reputation as a top terrorist and tarnishing "his amazing career." They are also looking into a seperate case to charge the U. S. with war crimes under the Geneva Convention, where torture of POW's was forbidden.

The Pentagon, which has so far said it doesn't take the case seriously, says that if it actually goes to court, they are "very confident" they will win. Bush, in a recent news confrence, scoffed at the report, laughing that he hopes bin Laden sees it so that he would give up under U. S. terms. He says, "Osama might fear for his reputation that a picture like that might be circulated."
